Overview of Appellate Jurisdiction

The Appellate Jurisdiction Outline is a tool to help attorneys figure out if the U.S. Court of Appeals for the Ninth Circuit has the legal authority—called "jurisdiction"—to hear a case.

It brings together the key laws, rules, and court decisions that affect appellate jurisdiction in the Ninth Circuit. The outline covers topics such as:

  • When and how civil cases can be appealed

  • Deadlines and rules for filing a notice of appeal

  • What issues the court can review on appeal

  • Appeals from federal agencies and the U.S. Tax Court

  • Criminal appeals

  • Constitutional limits on federal court jurisdiction

  • This outline is just a helpful resource to get you started. It is not official and should not be cited or used in your case.
